Terms of Service.

Agreement

These Terms of Service ("Terms") govern your use of orch.live (the "Website") and the Orch Code desktop application (the "App"), together the "Services", provided by Orch ("Orch", "we", "us"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility and accounts

You must be at least 16 years old to use the Services. You sign in with a Google account and are responsible for activity under your account. Tell us promptly at sameer@orch.live if you suspect unauthorised use.

License to use Orch Code

Subject to these Terms, Orch grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control. You may not sell, sublicense, reverse engineer (except where the law allows), or remove notices from the App.

Monthly AI credits

Each account receives an AI usage allowance, currently $50 per month, measured against the cost of the model requests you make.

• Credits have no cash value and cannot be transferred, sold or exchanged
• Unused credits do not roll over unless the App says otherwise
• We may change the allowance, the models available or how usage is measured, with notice in the App
• We may limit or suspend credits for abuse, automated reselling or activity that harms the Services

AI output

The App uses models from third-party providers, including OpenAI and Anthropic. AI output can be inaccurate, incomplete or unsuitable for your purpose. You are responsible for reviewing changes the agent proposes before accepting them, and for how you use any output.

Your use of AI features must also comply with the usage policies of the model providers.

Third-party integrations

You can connect services such as Google Drive, Gmail, Notion, Slack, Jira and GitHub. Those services are governed by their own terms. You authorise the App to access them on your behalf, using tokens stored on your device, and you are responsible for having the rights to the data you connect.

Your content and blog submissions

You keep ownership of your files and of content you write. When you submit a post to the Orch blog, you grant Orch a worldwide, royalty-free license to host, display, reproduce, adapt for formatting, distribute and promote it on the Services for as long as it is published.

Submissions are reviewed. Orch may approve, reject, request changes to, unpublish or remove any post at its discretion. You can request edits or removal of your published posts from your dashboard.

You confirm that you have the rights to everything you submit, including images, and that it does not infringe anyone's rights.

Acceptable use

You agree not to:

• Break the law or infringe anyone's rights
• Upload malware, or try to access accounts, systems or data without permission
• Interfere with, overload or reverse engineer the Services or their security
• Use the Services to create spam, harassment, hateful or sexually explicit content, or content that exploits minors
• Resell access to the Services or credits, or evade usage limits

Orch's intellectual property

The Services, including the App, the Orch name, logo and Website design, are owned by Orch and protected by law. These Terms do not grant you any rights to our trademarks.

Feedback

If you send us ideas or feedback, we may use them without any obligation to you.

Suspension and termination

You can stop using the Services at any time. We may suspend or end your access if you violate these Terms, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination will survive.

Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Orch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or that data will not be lost. Keep backups of important files.

Limitation of liability

To the fullest extent permitted by law, Orch will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Orch's total liability for any claim relating to the Services is limited to the greater of the amount you paid Orch in the 12 months before the claim or USD 100.

Indemnity

You will indemnify Orch against claims arising from your content, your use of the Services or your violation of these Terms, to the extent permitted by law.

Governing law

These Terms are governed by the laws of the country in which Orch's operator is established, without regard to conflict-of-law rules. Nothing in these Terms limits rights you have under consumer protection laws where you live.

Changes

We may update these Terms. If changes are material, we will give notice on the Website or in the App before they take effect. Continuing to use the Services after that means you accept the updated Terms.
