Important: Please read these Terms carefully. By downloading, installing, or using Orch, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you") and Orch ("Company," "we," "us"), governing your access to and use of Orch (the autonomous desktop AI coding agent) and all associated services at orch.live (collectively, "Services").

By accessing or using the Services, you confirm that you are at least 13 years of age (or 16 in the European Union), have the legal capacity to enter into these Terms, and agree to be bound by them in their entirety.

These Terms incorporate by reference our Privacy Policy.

2. Description of Services

Orch is a desktop application for macOS and Windows that provides:

  • An autonomous AI coding agent capable of reading codebases, writing code, and executing multi-step software development tasks
  • Full browser use and web automation capabilities
  • Local filesystem access within user-authorized directories
  • Live voice dictation for hands-free coding
  • Built-in skills and Model Context Protocol (MCP) server compatibility

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable.

3. Accounts, Google OAuth & Authentication

Features of Orch require authentication via Google OAuth 2.0. By signing in with Google, you authorize us to access your basic Google account information (name, email, profile picture) in accordance with our Privacy Policy and Google's API Services User Data Policy.

You are responsible for maintaining the security of your Google account. You may not create multiple accounts to circumvent credit limits or other restrictions.

4. Acceptable Use Policy

You agree to use the Services only for lawful purposes. You must NOT:

  • Use the Services to generate malware, exploits, or software designed to harm systems or data
  • Attempt to gain unauthorized access to our servers, model infrastructure, or other users' data
  • Abuse credits using automated bots or scripts
  • Resell or commercially exploit compute credits without express permission
  • Violate any applicable local, national, or international law

5. Free Credits, Billing & Payments

5.1 Free Monthly Credits: Each user with a valid Google account receives $50 (USD) of free compute credits per calendar month. Credits reset automatically on the 1st of each month.

5.2 Credit Expiration: Unused credits do not roll over to the following month and expire at month-end.

6. Intellectual Property

6.1 Ownership: All code, software, assets, and content you generate using Orch remains your property. Orch claims no ownership over user-generated code or project files.

7. Disclaimers & Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI language models can produce inaccurate outputs. You are responsible for reviewing and verifying any code generated by Orch before deploying it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

9. Termination

You may stop using the Services at any time. We reserve the right to suspend accounts that violate our acceptable use policy.

10. Dispute Resolution

Prior to formal proceedings, you agree to attempt informal resolution by contacting us at sameer@orch.live.

11. Governing Law

These Terms are governed by applicable laws without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. Material updates will be posted on orch.live prior to taking effect.
