By creating an account, accessing, or otherwise using the Service, you represent that:

If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Description of Service
Orch provides:
- OrchAI Chat: An AI-powered conversational assistant powered by Google's Gemma 3 27B model. Anonymous users may send up to 5 messages per hour. Registered users have no rate limits.
- Blog Platform: A curated editorial space publishing content related to AI, software development, and technology.
- OrchAI Android App: The native Android application providing the same AI chat functionality on mobile devices.
- Admin Panel: A content management interface available to users with administrator privileges for managing blog posts and news items.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. Account Registration and Security
To access certain features you must create an account via Google Sign-In or phone number (OTP). You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorized use of your account at sameer@orch.live.
- Not share your account credentials or allow others to access your account.
- Not create accounts through automated means or create multiple accounts for the purpose of circumventing rate limits or other restrictions.
We reserve the right to suspend or terminate accounts that violate these provisions.
4. User-Generated Content
When you submit content (including chat messages, display names, or any other information), you:
- Retain ownership of your content.
- Grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely for the purpose of providing the Service.
- Represent that you own or have the necessary rights to the content, and that it does not infringe any third-party rights.
- Understand that chat messages sent to OrchAI are processed by Google's Gemma API to generate responses.
We do not claim ownership of your conversations or any intellectual property you share with the AI.
5. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable law, regulation, or third party's rights.
- Generate, distribute, or promote illegal content, including but not limited to content that is obscene, defamatory, threatening, or constitutes hate speech.
- Attempt to generate content that facilitates violence, terrorism, child exploitation, or self-harm.
- Circumvent, disable, or interfere with security features of the Service, including rate limiting mechanisms.
- Scrape, crawl, or systematically collect data from the Service without our express written consent.
- Reverse engineer, decompile, or disassemble any software component of the Service.
- Upload or transmit viruses, malware, or any other malicious code.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use the Service to spam, phish, or send unsolicited messages.
- Attempt to gain unauthorised access to other users' accounts or data.
- Use the AI to generate academic dishonesty, fraud, or deception targeted at real individuals.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice.
6. AI-Generated Content Disclaimer

OrchAI is powered by the Gemma 3 27B language model. AI-generated responses may be inaccurate, incomplete, outdated, or misleading. Do not rely on AI-generated content for medical, legal, financial, safety-critical, or other professional advice.
- We do not guarantee the accuracy, reliability, or completeness of any AI-generated output.
- AI responses do not represent the opinions or views of Orch.
- You assume full responsibility for how you use AI-generated content.
- Always verify information from authoritative sources before acting on it.
7. Intellectual Property Rights
The Service, including the Orch website design, logo, source code, blog content authored by Orch, and all associated materials, is owned by Orch and protected by applicable intellectual property laws.
- You may not copy, reproduce, distribute, or create derivative works from our proprietary content without express written permission.
- The Orch name and logo are trademarks of Orch. You may not use them without prior written consent.
- Open-source components of the Service are subject to their respective open-source licences.
8. Third-Party Services
The Service integrates with third-party services including:

9. Rate Limiting and Free Tier
To ensure fair access and prevent abuse:
- Unauthenticated (anonymous) users are limited to 5 AI chat prompts per hour, tracked by IP address.
- Authenticated users currently have no rate limits on chat prompts.
- We reserve the right to implement rate limits or usage quotas on any tier at any time.
- Attempting to circumvent rate limits (e.g., by using VPNs, proxies, or creating fake accounts) is a violation of these Terms and may result in account termination.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY AI-GENERATED CONTENT.
- WARRANTIES THAT DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow exclusion of implied warranties, so the above exclusion may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
- DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.
- DAMAGES ARISING FROM AI-GENERATED CONTENT THAT YOU ACT UPON.
- UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA.
In no event shall our total aggregate liability exceed ₹1,000 (Indian Rupees) or the equivalent in your local currency.
13. Indemnification
You agree to indemnify, defend, and hold harmless Orch and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Service.
14. Termination
- We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
- You may delete your account at any time through your profile settings or by contacting us.
- Upon termination, your right to use the Service ceases immediately.
- Sections 6, 7, 11, 12, 13, and 15 shall survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, specifically including the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Digital Personal Data Protection Act, 2023, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 of India, conducted in English, with the seat of arbitration in India.
For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law.
16. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:

- Post a notice on orch.live for significant changes.
